Contrary to what most people may think, the law does not state who has the right of way, but instead, who is required to yield the right of way. The driver who must yield should always stop and yield to oncoming traffic; but how do you know which driver that is?

Generally speaking, you should yield to the driver who is first at an intersection. If both cars arrive at the same time, then you are required to yield to the driver on the right. The same rule applies if you are at a four-way stop; the vehicle on the left should yield to the vehicle on the right. If you are at an intersection where there is no signal or signs for cross traffic, you must always yield to crossing traffic.

The right of way should always be yielded if:

  • You are at a yield sign.
  • For handicapped people.
  • Pedestrians.
  • To other vehicles at an uncontrolled or “T” intersection.
  • To all oncoming cars, pedestrians and bikers when turning left.
  • When returning to a roadway from a parking area.
